What will Kin Papers fill in for Missouri?
Kin Papers is building a Missouri file that fills in form PR 16 or PR 17 and its exhibits from your answers, writes the letters banks, Social Security and the credit bureaus ask for, prepares IRS Form 56, and keeps a dated tracker of the 30-day wait and the year-long creditor window. Who can sign a Missouri small estate affidavit?
When there’s a will that was presented for probate in time, the person it names as personal representative can sign. Otherwise any distributee, someone entitled to receive the property, can sign once 30 days have passed. Form PR 16 is for estates without a will and form PR 17 for estates with one. Both are sworn before a notary.
What does the affidavit have to list?
RSMo 473.097 requires:
- Whether there’s a will, and that it was presented in time.
- That the debts and taxes have been or will be paid, up to the value received.
- Each item of property with its value, and who holds it.
- The name, address and relationship of each person who will receive property, and why they’re entitled to it.
The forms add that when the death was less than a year before filing and debts bring the value down to $40,000, a list of creditors and amounts owed is attached.
What happens after it’s filed?
The clerk of the probate division endorses a certificate naming who is entitled to the property. Holders then deliver the property to the person who signed, who pays the parent’s debts first and then distributes what’s left. Real estate passes by recording the affidavit and the clerk’s certificate with the recorder of deeds in each county where the land is. The statute says this has the same effect as a full administration.
Where do you get the official forms?
The Missouri Courts probate forms page has PR 16, PR 17 and the exhibits for listing property and heirs or legatees. The page also says a filing information sheet is required with each case.
What if the estate is over $40,000?
Then the affidavit isn’t available and the estate goes through probate, where the court issues letters to a personal representative. The probate clerk can explain the filings, and a lawyer can advise on your situation.
Is Kin Papers a law firm?
No. Kin Papers isn’t a law firm and doesn’t give legal advice. This page explains what Missouri’s statute and court forms say, with links to each. It doesn’t say whether the affidavit fits your parent’s estate.
